The Office of Management and Budget must make the council’s requested transfers between budget lines, except for the staffing pool. The council must notify lawmakers and report transfers over $50,000.

The law makes cultural endowment income and certain gifts available to the council for arts purposes. This covers cultural endowment income and gifts, grants, bequests, donations, and assignments received by the Council on the Arts. Accrued endowment interest may pay to make, prepare sites for, and install creative placemaking art, including interest tied to money set aside for maintenance. These appropriations apply from July 1, 2025, through June 30, 2027.
The law allows the council to request budget transfers and requires it to report certain transfers. These rules cover transfers among the Council on the Arts’ budget lines. The Office of Management and Budget must make requested transfers between budget lines, except transfers involving the new and vacant FTE pool. The council cannot spend directly from that pool, but may request a transfer from it to salaries and wages under separate guidelines. The council must notify the Legislative Council of transfers. After June 30, 2026, the council must report transfers over $50,000 to the Budget Section. It must report transfers under this section to the next legislative assembly’s appropriations committees.
The law sets aside money for named arts work and allows certain unused leave funds to carry over. The grants include funding for the state troubadour and poet laureate; the one-time education funding is for Arts Across the Prairie. The $25,000 carryover is limited to costs for accrued leave payouts. The $5,000 education funding is one-time. The leave-payout money is available during the period from July 1, 2025, through June 30, 2027.
