Unemployment benefits would be reduced by 65% of the covered retirement payment assigned to that week. The rule covers retirement payments from a plan promising a set benefit, based on work for the employer the worker left or an employer whose wages count toward the unemployment claim. That employer must account for at least 75% of the worker's total service used for the pension. The reduction would apply only to the extent federal unemployment tax rules allow. Social Security payments would be exempt. The reduction would apply to weeks beginning during a period for which the worker receives covered retirement payments.
City and town employees would be denied unemployment benefits under the circumstances referenced in section 28A(a) through (c). The provision covers city and town employees working for or on behalf of an educational institution. The employee must provide services of the kinds covered by section 28A(a) and (b).
