If a convention is called to propose changes to the U.S. Constitution, Missouri lawmakers would choose district delegates and tell them what they may consider and how to vote.
If an Article V convention is called, a legislative committee would submit candidates, and the House and Senate would choose one delegate and one alternate from each Missouri congressional district.
Before a convention, lawmakers would set instructions on what Missouri's delegates may consider and how they vote. Delegates and alternates would swear to follow those instructions.
A legislative committee would investigate reports that delegates went beyond their instructions and could remove a delegate who cast or tried to cast a vote outside the rules.
The House and Senate would choose one delegate and one alternate from each congressional district. Candidates would need to be Missouri citizens who meet the qualifications for the Missouri House. Federal lawmakers and employees, federal contractors' employees or representatives, and statewide elected officials could not serve. A legislative committee would submit at least three eligible candidates for each position in each district. The House and Senate would choose from those candidates by joint resolution. At least one-third of delegates and alternates could not be sitting legislators. The committee would be authorized after or near the time a convention is called.
The General Assembly would give delegates instructions, and each delegate and alternate would swear to follow them. These rules would apply to Missouri delegates and alternates taking part in an Article V convention. Instructions would require each state to have one vote and a simple majority of Missouri delegates to decide Missouri's vote. A vote outside the instructions or the limits in Missouri's application for the convention would be unauthorized and void. Lawmakers could change the instructions before or during the convention.
A joint legislative committee would investigate reports of rule-breaking and could recall a delegate who casts or tries to cast an unauthorized vote. The committee would oversee Missouri's delegates and alternates at an Article V convention. The committee would have to recall a delegate only for casting or trying to cast an unauthorized vote. The committee would appoint an alternate to replace a recalled delegate. The General Assembly could change committee actions or recall or replace delegates and alternates by joint resolution. The committee could investigate reports and advise delegates before or during the convention.
No hearings or votes scheduled.
