The proposal would place mifepristone in Schedule IV and treat secretly using an abortion-inducing drug to cause an abortion as a class B felony.
Knowingly and intentionally using an abortion-inducing drug on a pregnant woman without her knowledge or consent, intending to cause an abortion, would be a class B felony.
The proposal would list mifepristone as a Schedule IV controlled substance.
A person who knowingly and intentionally uses an abortion-inducing drug on a pregnant woman without her knowledge or consent, intending to cause an abortion, would commit a class B felony. The offense applies when a person uses an abortion-inducing drug on a pregnant woman without her knowledge or consent. The person must act knowingly and intentionally and intend to cause an abortion. If the drug use causes the woman’s death or serious bodily injury, prosecution under this section would not prevent prosecution under another law, including murder.
Mifepristone would be listed among the Schedule IV controlled substances. The listing appears in the bill’s section on Schedule IV controlled substances.
