When an Article V convention is called, Missouri lawmakers would select a commissioner and alternate from each district and set rules for the delegation.
If an Article V convention is called, lawmakers would choose one commissioner and one alternate from each Missouri congressional district from candidates recommended by a joint committee.
Lawmakers would set the subjects and voting rules Missouri's convention delegation must follow, including one vote per state and a majority decision for Missouri.
A joint committee would investigate reports that commissioners broke their instructions and must remove a commissioner who casts or tries to cast an unauthorized vote.
The Missouri General Assembly would choose one commissioner and one alternate from each congressional district. Each commissioner and alternate must live in Missouri and meet the qualifications for the Missouri House. Members of Congress, federal employees, federal contractors or their representatives, and statewide elected officials cannot serve. The joint legislative committee must submit at least three eligible candidates for each role in each district. At least one-third of commissioners and one-third of alternates must not be sitting members of the General Assembly. These selections apply when a convention is called to propose amendments to the U.S. Constitution.
The General Assembly would set instructions for the commissioners by concurrent resolution. These instructions govern Missouri's commissioners and alternates at an Article V convention. Instructions must limit what commissioners may consider and vote on, including convention procedures and proposed amendments. They must require one vote per state and make a simple majority of Missouri commissioners decide the state's vote. A vote outside the instructions or the limits in Missouri's convention application would be void. The General Assembly must adopt instructions before the convention, and may change them before or during it.
A joint legislative committee would investigate possible violations and could recall commissioners who cast or try to cast an unauthorized vote. The committee is made up of five senators and five representatives, with three majority-party and two minority-party members from each chamber. The committee must recall and revoke a commissioner's authority only for casting or attempting an unauthorized vote. The committee must appoint a selected alternate to replace a recalled commissioner. The General Assembly may change committee actions or recall or appoint commissioners and alternates by concurrent resolution. The General Assembly authorizes the committee after or near the time an Article V convention is called.
No hearings or votes scheduled.
