Each year, the state treasurer transfers five percent of estimated taxes from electric power distribution to the air pollution program, if lawmakers approve spending the money.
Starting July 1, 2027, unspent Natural Resources Protection Fund balances above the previous two years' collections stay in the fund instead of returning to general revenue.
A person with a contract to store water in a U.S. Army Corps of Engineers reservoir has exclusive rights to return flows sent there. The rule covers people who contracted for the right to store water in a reservoir owned by the U.S. Army Corps of Engineers. A return flow is water discharged to the reservoir by a water reclamation facility. These rights remain subject to state rules and depend on unused reservoir storage capacity being available to that person.
The state treasurer transfers five percent of estimated state sales and use taxes from electric power distribution to the air pollution permit fee subaccount. The estimate covers state general revenue sales and use tax from electric power distribution in the previous calendar year. The department may use the money only for the air pollution control program and only if the General Assembly approves spending it. The transferred money does not return to general revenue at the end of a two-year budget period. Beginning July 1, 2027, and each July 1 after that, the commissioner of administration estimates the tax amount using reports for the previous calendar year. The treasurer transfers five percent of that amount.
Unspent balances in Natural Resources Protection Fund subaccounts above the previous two years' collections stay in the fund instead of returning to general revenue. This applies to unspent balances in the fund's subaccounts that exceed collections during the preceding two-year budget period. This rule begins July 1, 2027, and applies to balances at the end of each two-year budget period.
