An Act To Clarify Responsibility For Compensation Of Court-Appointed Attorneys In Certain Proceedings
In listed Maine court proceedings, an indigent nonparty witness would qualify for legal services only to protect the right against self-incrimination.
1
What it does
An indigent nonparty witness in a listed proceeding would have legal services counted as indigent legal services only when they are needed to protect the right against self-incrimination.
Argument forIndigent witnesses in covered cases may get help protecting their right to avoid answering questions that could incriminate them.
Argument againstWitnesses could have to find another way to pay for legal help beyond what is needed to protect their right against self-incrimination.
More detail
The amendment defines covered legal services for an indigent nonparty witness as only those needed to protect the witness's right against self-incrimination. This applies to a nonparty witness in a criminal, juvenile, emancipation, child protection, involuntary commitment, involuntary treatment, or extreme risk protection order proceeding. The witness must be located in Maine and a court must find the witness indigent.
