Maine blocks sales of covered containers when initiators miss reports
Initiators that miss annual reports face penalties, and their covered containers cannot be sold while the reporting violation continues.
1
What it does
Initiators that miss annual reports face a violation and penalties. While it continues, they and their distributors or dealers cannot sell covered containers; the department may remove them from sale.
Argument forPenalties and sales restrictions could encourage initiators to file annual reports, helping the department enforce deposit reporting rules.
Argument againstSales restrictions could disrupt distributors and dealers that handle containers from an initiator whose annual report is overdue.
More detail
An initiator that fails to report annually commits a violation and faces penalties under section 3111. The initiator, its distributors, and its dealers may not sell or distribute its covered containers; the department may remove them from sale. This applies to deposit initiators that fail to report annually, and to containers covered by Maine’s deposit law. The sales restrictions apply while the reporting violation exists. The department may remove the containers from sale but is not required to do so. The sales restrictions apply for as long as the reporting violation exists.
