Cannabis businesses may use earlier tests under a contaminant-level condition
Cannabis businesses can use earlier test results under a condition tied to contaminant levels, with a specific exception for concentrate used in edibles.
1
What it does
Earlier test results may be used if later processing does not raise tracked contaminants or other factors. Making an edible from cannabis concentrate is excluded from this condition, except for one specified test.
Argument forCannabis businesses may avoid some repeat testing when later processing does not raise the levels of contaminants or other factors the state tracks.
Argument againstPeople using edible cannabis products might have less protection from repeat testing when concentrate is used to make an edible, except for one specified test.
More detail
The law sets a condition for when earlier test results may be used after cannabis or a cannabis product is processed. The condition applies to cannabis or cannabis products that received earlier testing under section 605, subsection 1. Later processing, manufacturing, or alteration must not raise the concentration of contaminants or other factors identified in state law or rules. For this condition, using cannabis concentrate to make an edible does not count as further processing, except for testing under section 602, subsection 1, paragraph F. The law took effect when approved, on April 19, 2026.
