Maine law exempts some municipal public parking from state requirements
Maine law exempts municipalities with certain paid parking rules on their public property from the requirements in subsection 1.
1
What it does
A municipality with an ordinance for public parking on its own property and charges for violations is exempt from subsection 1’s requirements.
Argument forMunicipalities could use local parking rules and charge for violations without also meeting subsection 1’s requirements.
Argument againstDrivers could face different parking requirements on municipal property, which may make it harder to know which rules apply.
More detail
A municipality is exempt from subsection 1’s requirements. The exemption covers a municipality’s rules for motor vehicle parking on its own property that is open to the public. The municipality must have an ordinance regulating at least one motor vehicle parking rule on property it owns and makes available to the public. The ordinance must include fines, fees, or charges for violations.
