Covered facility owners would fully compensate landowners, with Illinois’ Department of Agriculture setting payment amounts. Covered owners include developers during development. Wind facilities must have at least 500 kilowatts of rated generating capacity; commercial solar facilities also qualify. The facility must harm water flow on the landowner’s land, adjoining land, or drainage district land, including through underground drainage pipes. Certain utility-scale solar projects being built at sites eligible for an Illinois Power Agency power purchasing event are excluded.
