Investors could transfer Kansas housing tax credits to other people, who could claim them starting in the original investment year.
People receiving a transferred housing tax credit could claim it starting in the year the original investor made the investment. The credit still expires under the four-year limit measured from the year it was issued.
A person who receives a transferred credit may claim it starting in the year the original investor made the cash investment. A qualified investor or a later recipient may transfer all or part of the credit to one or more people, including people who are not qualified investors. The credit may be transferred more than once, but the total cannot exceed the amount issued. The recipient must provide required information and follows the original holder's remaining rights and limits. Any unused credit may be carried forward for up to four tax years after the year it was issued; any remainder is forfeited. The proposal says these transfer rules would apply retroactively to credits issued for tax year 2022 and later.
