Kansas Guard members would need a war declaration or Congress’s explicit call to enforce federal laws, repel an invasion, or suppress an uprising before leaving Kansas for combat. Certain missions supporting civilian authorities in the United States and its territories would remain allowed.
Kansas National Guard members would be barred from leaving the state for combat unless Congress takes one of the specified actions. The restriction would cover the Kansas National Guard and individual members. Combat means federal military service involving armed conflict, hazardous work related to armed conflict abroad, or duties using tools of war. Congress would have to declare war or explicitly call the Guard to enforce federal laws, repel an invasion, or suppress an uprising. The governor could still approve missions supporting civilian authorities within the United States and its territories under Title 32, the federal law governing those Guard missions. The governor would have to take all actions needed to follow these requirements. If enacted, the proposal would take effect after publication in the statute book. It died in committee and did not take effect.
