The failed proposal would place both less serious and more serious impaired-driving convictions in Kansas’s legal category called “person crimes,” including commercial vehicle offenses.
People convicted of impaired driving, including commercial drivers, would have their offenses labeled “person crimes.” The proposal covers both misdemeanors, which are less serious crimes, and felonies.
Kansas courts would use the legal category called “person crimes” for these impaired-driving convictions. The category would cover both misdemeanor and felony convictions for driving under the influence in Kansas, including commercial vehicle offenses. For ordinary vehicle offenses, a third conviction would be a felony if a prior conviction occurred within the preceding 10 years, excluding time in prison. Otherwise, it would be a misdemeanor. Fourth or later ordinary vehicle convictions and third or later commercial vehicle convictions would be felonies. If enacted, these classifications would take effect after publication in the statute book.
