In a divorce case involving a public employees’ retirement fund member, a court could assign or garnish part or all of the member’s monthly benefits for another party.
A court may order all or part of a member’s monthly benefits assigned to another party, or garnished and transferred to that party. This applies when a public employees’ retirement fund member is a party to a marriage dissolution case. The order must be made in a divorce decree. The board must pay the ordered amounts to the parties named in the order and in the proportions it sets. The board pays the ordered amounts when the member is entitled, or was entitled, to receive them.
