Subject to federal Title IV-E requirements, adoptive parents whose children qualify for Medicaid and their private plan could request a switch; the state would check coverage before approving it.
Parents could ask to move an adopted child from Medicaid to the parent's private plan when the child qualifies for both, subject to federal Title IV-E requirements. Before approving the request, the state must confirm coverage will not lapse during the switch.
The proposal would let an adoptive parent opt the child out of Medicaid. This applies when the adopted child qualifies for both Medicaid and dependent coverage under the parent's private health plan. Federal Title IV-E requirements still apply. The parent must file a request with the Department of Child Services. Before approving it, the department must confirm the child qualifies for the parent's private plan and will not have a gap while switching. The chapter would take effect July 1, 2026.
