If enacted, Indiana would leave certain lined ponds outside its dam rules starting July 1, 2026, unless they are listed as low head dams.
Indiana's dam rules would not apply to manmade basins designed to collect and store surface water in an impervious membrane liner, unconnected to natural rivers, streams, or lakes, unless listed as low head dams.
The proposal would exempt qualifying retention ponds from this chapter's dam rules, except listed low head dams. A retention pond is a manmade basin designed to collect and store surface water in an impervious membrane liner, with no connection to a natural river, stream, or lake. The chapter would still apply to a structure listed on the low head dam roster. If enacted, this provision would take effect July 1, 2026.
