Local permit authorities would need zoning beneath a proposed commercial solar overlay to allow the project before establishing it, or rezone all or part of a district that does not.
For solar overlays established after December 31, 2025, local authorities would need the zoning beneath them to allow the project. Where it does not, they would need to rezone all or part of the district.
Permit authorities may establish an overlay for a commercial solar project only when each underlying zoning district allows it. Commercial solar projects can involve building, operating, or removing systems meant to sell electricity wholesale for use elsewhere. Any underlying district that does not allow the project must be rezoned under this chapter to allow it in all or part of that district. This applies to overlays established on or after January 1, 2026; whether zoning allows the project is checked when the overlay is proposed.
