For reports filed after 2026, Indiana utilities could not earn a return on costs of early large-plant closures if regulators investigate but do not block the closure and no environmental law, regulation, or court order requires it.
For reports filed after 2026, utilities that close large power plants early could not collect extra earnings on related retirement costs if regulators investigate but do not block the closure and no environmental law, regulation, or court order requires it.
Indiana electric utilities could not collect a return, or extra earnings, on certain plant retirement costs in later rate cases. It would cover public utilities that permanently shut down generating resources rated at least 125 megawatts. Regulators must not have blocked the closure after investigating it. The closure must come before the retirement date in the utility's latest filed plan, if any, or before the end of the plant's economically useful life, as regulators determine. Environmental laws, regulations, or court orders must not require the closure. This would apply to reports filed after December 31, 2026, and to future rate cases or other regulatory proceedings.
