If passed, easements and other legal claims on vacated road land would end after twenty years, except those the landowner granted in writing.
Easements and other legal claims on vacated road land, along with rights tied to them, would end after twenty years. The rule would exempt easements and claims the landowner granted in writing.
Covered rights would end on the twentieth anniversary of the right-of-way’s vacation. This covers easements or other legal claims on or within the vacated right-of-way, and rights connected to or based on them. The rule does not apply to an easement or other claim if the owner of the former right-of-way land granted it in writing. The section would take effect July 1, 2026. The twenty-year period runs from the date the right-of-way is vacated.
