Retailers with high on-site wine sales could let customers choose sealed bottles themselves for off-site use, starting July 1, 2026, if the bill takes effect.
If enacted, retailers whose on-site wine sales make up at least 60% of annual premises income could let customers choose sealed bottles for off-site use from a qualifying room display.
The bill would allow a wine retailer to let customers take sealed bottles from a qualifying room display for off-site consumption. This applies only if wine sales on the licensed premises make up at least 60% of the premises’ annual gross income. The display must be in a room with a bar or where alcoholic drinks are stored, prepared, or served for drinking on the premises. The room cannot be divided to make a section solely or mainly for package wine sales, and it cannot have a separate register for those sales. The provision would take effect July 1, 2026.
