Hawaii insurers must share rebuilding costs and offer added coverage
At renewal, Hawaii homeowners insurers must explain whether coverage matches rebuilding costs and offer more coverage when it falls short.
1
What it does
At policy renewal, insurers must give homeowners a rebuilding cost estimate and say whether their current limit would cover that cost.
When a home's coverage limit is below its estimated rebuilding cost, the insurer must offer added coverage up to that estimate and show its price. The offer stays open for 30 days.
Insurers must keep support for each rebuilding estimate and record whether the homeowner accepted or declined the offered coverage.
Argument forHomeowners could spot a coverage gap before a disaster because insurers must provide updated estimates based on local costs and major rebuilding expenses.
Argument againstHomeowners who accept more coverage could pay higher premiums, since insurers must include the added coverage price in their offer.
More detail
Homeowners insurers must give policyholders a written rebuilding cost estimate and say whether their dwelling coverage limit would cover that cost. This applies to people named as insured under homeowners policies. The disclosure must be provided at least once every 12 months and coincide with policy renewal.
If the dwelling coverage limit is below the estimated replacement cost, the insurer must offer the policyholder the option to buy enough added coverage to match that estimate. The offer is required only when the policy's dwelling coverage limit is less than the estimated replacement cost. The offer must show the added premium, stay open for 30 days, and be renewed annually. The offer must be renewed annually.
Homeowners insurers must keep documents supporting each estimate and note whether the policyholder accepted or declined replacement cost coverage. The records cover estimates and policyholder decisions under this part. Failure to comply with these requirements counts as an unfair or deceptive insurance practice. Records must be kept for at least five years after the policy term ends.
