Hawaii bargaining-unit workers could challenge discipline unless contracts say otherwise
If enacted, the bill would let Hawaii public workers in bargaining units challenge discipline through a formal complaint process starting July 1, 3000, unless their contract specifically says otherwise.
1
What it does
If enacted, public workers in bargaining units could challenge suspensions, disciplinary firings, and other discipline. Their contract could specifically say otherwise; the rule would start July 1, 3000.
Argument forIf enacted, covered workers could seek a binding decision on discipline, which might help correct mistakes when their contract does not specifically bar complaints.
Argument againstIf enacted, complaints about discipline may take public employers’ staff time to answer when a worker’s contract does not specifically bar them.
More detail
If enacted, public employers would have to let covered workers use the formal complaint process to challenge discipline. This applies to Hawaii public employees who are members of a bargaining unit. A worker’s contract can specifically say that the worker cannot use this process to challenge discipline. If enacted, this rule would take effect on July 1, 3000.
