Hawaii officials may inspect tobacco sellers and seize property tied to violations
Hawaii tax officials and the attorney general may inspect tobacco sellers and seize property tied to violations; the measure also addresses forfeiture of tobacco products.
1
What it does
Tax officials and the attorney general may inspect tobacco sellers during business hours. If they find a violation, they may seize tobacco products, vending machines, vehicles, and related records.
Cigarettes and tobacco products involved in conduct that violates the tobacco law must be forfeited and destroyed. Contraband is subject to summary forfeiture to the State without chapter 712A procedures.
Argument forOfficials could inspect sellers' records and goods to check whether sellers follow tobacco tax rules.
Argument againstBusinesses could lose tobacco products, vehicles, or records when officials find a violation, which may disrupt their operations.
More detail
The Department of Taxation and the attorney general may inspect tobacco sellers and, when they have reasonable cause to suspect a violation, search and seize property. Inspections may cover entities that sell cigarettes or tobacco products, their premises and records, and vending machines. Inspections may take place during regular business hours. Officials may search when they have reasonable cause to believe tobacco products, stamps, or counterfeit stamps are involved in a violation. They may seize items and records if they find a violation. The text says the measure would take effect upon approval.
Cigarettes and tobacco products involved in violations must be forfeited and destroyed; contraband is subject to summary forfeiture to the State. The provisions cover cigarettes and tobacco products, including their packages, cartons, and containers. The forfeiture provision applies to cigarettes and tobacco products involved in conduct that violates this part, including unlawful possession, transport, sale, or offers to sell. The new section says forfeited products must be destroyed. The amended contraband provision says contraband is forfeited without the procedures in chapter 712A. The text says the measure would take effect upon approval.
