Medicaid expansion coverage for some adults under 65 would depend on income, other available coverage, federal funding, and community engagement compliance.
Adults under 65 with income at or below 133% of the federal poverty level and no other state-plan coverage are included in the Medicaid expansion rules.
If federal support for expansion coverage drops below 90%, lawmakers must review the program, while the department may temporarily cut payments or optional benefits to cover higher state costs.
After community engagement rules are implemented, applicants must show three months of compliance, and current expansion enrollees may lose coverage if they cannot show it.
The state must include eligible people in its Medicaid plan. This applies to people under age 65 whose modified adjusted gross income is no more than 133% of the federal poverty level and who are not eligible for other coverage under the state plan. The department must submit any needed state-plan amendments to federal health officials. Eligibility may not be delayed while the department seeks or negotiates a waiver, or because a waiver request is not approved. The department must submit needed amendments within 90 days after approval of the act and implement the provision as soon as practicable.
Legislative health committees must review the funding reduction and recommend whether coverage should continue; outside a legislative session, the department must offset higher state costs. These steps apply when federal financial participation for people covered by the expansion falls below the 90% level described in federal law. The committees may recommend keeping or ending the expansion after reviewing the reduction. Before the legislature can act, the department may reduce provider payment rates or eliminate optional benefits to offset increased state funding. The review and recommendation must occur by the end of the regular legislative session following the reduction; interim department actions continue until the legislature can meet.
The department must apply community engagement requirements to Medicaid expansion enrollment and disenrollment. This applies to people enrolled or seeking enrollment under the Medicaid expansion rules in this section. A person must show compliance for the three consecutive months immediately before the month of application. A person already enrolled under this section must be disenrolled if the person cannot show compliance. The department must implement the community engagement requirements by December 31, 2026; the enrollment and disenrollment rules apply after implementation.
