Since July 1, 2026, Idaho law allows cities and counties to form infrastructure districts after local petition review and required development approvals.
Cities and counties may form districts to finance infrastructure that Idaho or a local government will own. For phased development, approvals for the first phase are enough for initial district formation.
Cities and counties may form community infrastructure districts under the stated location and approval rules. Cities may form districts within their incorporated areas. Counties may form districts within a city's planning area only with that city's consent, or outside a city's planning area. A city may form a district within its incorporated area. A county may form one within a city's planning area only with that city's consent, or outside a city's planning area. Only infrastructure that Idaho or a local government will publicly own may be financed through a district. The governing body of each city or county where the district would be located must approve the formation petition. Required land-use and zoning approvals must also be obtained; for phased development, approvals for the first phase are enough for initial formation and organization. Forming a district does not remove local government powers or later land-use and zoning requirements. These provisions take effect July 1, 2026.
