Idaho law defines accounts independent contractors can use to buy benefits
Starting July 1, 2026, Idaho law describes how independent contractors can own accounts for benefit plans and who may administer those accounts.
1
What it does
The law describes accounts owned by independent contractors for buying benefit plans and lists who may administer them, including other providers approved by the insurance department.
Argument forContractors could use accounts they own to buy benefit plans for a beneficiary, such as health or disability coverage.
Argument againstOther providers might face a hurdle if they must convince the insurance department that their account services follow the chapter’s rules.
More detail
The law defines portable benefit accounts, benefit plans, and the providers that may administer accounts. An account is owned by an independent contractor and pays for one or more benefit plans. A plan is administered by a third-party provider chosen by the contractor and assigned to a beneficiary, not the hiring party. A provider may be a bank, investment firm, or technology provider working through a bank or investment firm. Another provider may qualify if the insurance department is satisfied that its account services will follow the chapter’s rules. The act takes effect July 1, 2026.
