1
What it does
For plans issued or renewed on or after January 1, 2027, covered FDA-approved oral cancer medicines must have the same plan cost-sharing rules as injected or intravenous cancer medicines. Plans may still use prior approval and other appropriate coverage controls.
Argument forPeople taking covered oral cancer medicines could face the same plan cost-sharing rules as people receiving injected or intravenous medicines.
Argument againstPeople may still need prior approval or face other coverage controls, so matching cost-sharing rules may not ensure a particular medicine is covered.
More detail
Health plans must apply the same plan cost-sharing rules to covered oral cancer medicines as to injected or intravenous cancer medicines. This applies to a health benefit plan issued or renewed on or after January 1, 2027. The rule applies to FDA-approved anticancer medicines covered by the plan. Plans may still use preferred drug lists, prior approval, and other appropriate controls when approving coverage. The law takes effect July 1, 2026. The cost-sharing rule applies to plans issued or renewed on or after January 1, 2027.
