What it does
Driving more than 20 mph above the posted limit counts as reckless driving in active school zones with children present and visible or active construction zones with workers present and visible.
Argument forTreating this speeding as reckless driving could discourage drivers from speeding where children or road workers are present and visible.
Argument againstDrivers exceeding the zone speed threshold could face jail or fines without a separate finding that they endangered someone.
