Hemp producers would avoid negligent violations under listed conditions
Starting July 1, 2026, hemp grown only for grain or fiber would not count as a negligent violation if producers follow state rules and keep THC at or below 1%.
1
What it does
Producers growing hemp only for grain or fiber would not commit a negligent violation if they follow state requirements, make reasonable growing efforts, and keep THC at or below 1%.
Argument forThe provision could protect grain and fiber producers from a negligent violation when they make reasonable efforts and meet the THC limit.
Argument againstThis may leave producers growing hemp for cannabinoids outside the protection, so an accidental THC exceedance could still trigger negligent-violation consequences.
More detail
Hemp producers meeting all listed conditions would not commit a negligent violation. The provision covers hemp producers growing hemp solely to produce grain or fiber. Producers must make reasonable efforts to keep hemp within the acceptable hemp THC level set by rule. Producers must follow Idaho laws, rules, and the state hemp plan. The hemp must contain no more than 1% total THC by dry weight. The provision applies on and after July 1, 2026.
