What it does
Starting January 1, 2027, sellers and distributors would be barred from dealing in covered disposable smoking devices, except devices authorized for sale under a federal marketing order.
Argument forKeeping covered devices out of stores could reduce discarded batteries and plastic that may harm land, waterways, and wildlife.
Argument againstPeople who use these devices might have fewer options to buy them in Hawaii, except for devices covered by a federal marketing order.
More detail
The bill text would make it unlawful to sell, offer for sale, or distribute covered disposable electronic smoking devices. The rule covers people and businesses dealing in devices that deliver nicotine or other substances, cannot be refilled, have a non-rechargeable battery, and are meant to be discarded after use. It includes electronic cigarettes, cigars, cigarillos, pipes, and related cartridges or components. Devices authorized for sale under a federal Food and Drug Administration marketing order are excluded. Selling 20 or fewer covered devices in violation counts as one violation under this section. The proposed prohibition would begin January 1, 2027.
