Health plans would cover fertility care before cancer treatment
Eligible health plans would cover fertility-preserving services for people facing cancer treatment likely to cause infertility, beginning with plans issued or renewed after December 31, 2026.
1
What it does
Eligible health plans would cover standard fertility-preserving services for people facing cancer treatment likely to cause infertility. Coverage excludes experimental procedures, third-party reproduction, and storage of frozen material.
Health maintenance organizations would include the fertility-preservation benefit in their plans, with the listed limits on covered services.
Argument forPeople facing cancer treatment that is likely to cause infertility may get coverage for established fertility-preserving care guided by clinical standards.
Argument againstPeople may still have to pay for fertility storage or third-party reproduction because the listed coverage excludes those services.
More detail
Health insurers and mutual benefit societies would cover standard fertility-preserving services. This applies to individual or group insurance policies and hospital or medical service plan contracts. The coverage is for policyholders or members and covered people under 26 when an insured or covered person may undergo qualifying treatment. The treatment must be cancer-related and likely to cause infertility. Plans may not restrict required coverage because of an earlier diagnosis or fertility treatment, or discriminate based on health conditions, disability, medical needs, or expected length of life. Any limits must reflect the person's medical history and follow the full scope of the 2018 American Society of Clinical Oncology guidelines. Coverage does not include experimental or unestablished procedures, third-party reproduction such as donor eggs or surrogates, or storage of frozen material. The requirement applies to policies and plan contracts issued or renewed after December 31, 2026.
Health maintenance organizations would include the fertility-preservation benefit in their plans. This applies to health maintenance organization policies, contracts, plans, or agreements issued in Hawaii. The referenced benefit is subject to the service limits and exclusions in the bill text. The benefit applies to plans issued or renewed on or after December 31, 2026.
