Military children's school compact refers to federal duty rules
Public education agencies applying the military children's compact use federal code references to identify active duty service members whose children are covered.
1
What it does
The compact's active duty definition and coverage rule refer to chapters 1209 and 1211 of the federal code. Its rules apply only to certain military families and public education agencies.
Argument forUsing federal code references could help schools identify which active duty orders qualify a military family's children for the compact.
Argument againstSchools may need to check the federal code references when deciding whether a service member's orders meet the compact's active duty definition.
More detail
The compact's active duty definition and coverage rule refer to chapters 1209 and 1211 of the federal code. The compact covers school-aged children in military families, including children of active duty service members. The compact applies only to appropriate education agencies. It also covers children of severely injured and medically discharged or retired service members for one year, and children of service members who die on active duty or from active duty injuries for one year after death. It excludes children of inactive Guard or reserve members, most retired members and veterans, and civilian or contract workers who are not active duty members. The text says the Act takes effect upon approval.
