Residential projects under 100 units would not pay school impact fees
If approved and effective, housing projects with fewer than 100 units would be exempt from school impact fees until July 1, 2029.
1
What it does
Residential projects with fewer than 100 dwelling units would not pay school impact fees, but developers could not split larger projects to qualify.
Previously signed school-facility contribution agreements would stay in place unless both sides agree to change or end them.
Argument forDevelopers of smaller projects may face lower costs, which could make it easier to build homes within existing communities.
Argument againstLarge developments could not avoid the fees by dividing construction into smaller phases, which may limit the exemption for some projects.
More detail
Housing projects with fewer than 100 dwelling units would be exempt from school impact fees. The rule covers residential housing projects, including their subdivisions and development phases. Separate subdivisions or phases count as parts of the same housing project. Developers may not artificially divide or phase a project to avoid the fee requirements. The exemption would apply when the Act takes effect and would end when the Act is repealed on July 1, 2029.
Existing education contribution agreements would remain in effect unless the parties mutually agree to end or renegotiate them. The protection covers agreements with the Department of Education or the School Facilities Authority that were signed before the Act takes effect. Both parties must agree to terminate or renegotiate an agreement. The protection would begin when the Act takes effect and would apply until the agreement ends, is renegotiated, or the Act is repealed on July 1, 2029.
