Some Hawaii housing projects would require resident resale limits
The proposed rules would let the corporation approve certain housing projects for exemptions if most homes go to qualified residents and deed restrictions apply.
1
What it does
The corporation may approve certain housing projects for exemptions from government rules if it approves the project and at least 80% of its homes go to qualified residents. County and land-use approval is also required.
Homes in qualifying projects must stay owner-occupied for at least one year after the first sale. A deed restriction requires a Hawaii-domiciled occupant, rentals of at least one year, and resale to a qualified resident.
A qualified resident must be a U.S. citizen or resident alien, at least 18, domiciled in Hawaii, and physically living in the home they buy or rent. For market-priced homes in an economically integrated project, the developer sets other qualifications.
Argument forKeeping most homes for qualified residents and requiring long-term leases could help preserve housing for people who live in Hawaii.
Argument againstThe one-year occupancy rule and lasting rental and resale limits could make it harder for some owners to move or rent out a home.
More detail
The corporation may approve certain housing projects for exemptions from government rules if the listed conditions are met. These provisions cover projects developed by the corporation, with an eligible developer, or with government assistance. The corporation must approve the project, find it fits the chapter’s purpose and meets basic health and safety needs, and give the county a chance to comment. At least 80% of the project’s homes must be sold to qualified residents. County and Land Use Commission approval is also required; a project or petition not rejected within 45 days is deemed approved. The county and Land Use Commission have 45 days to act after receiving the required plans or petition.
Each home in a qualifying project must have a deed restriction that limits occupancy, rentals, and resale. The restrictions apply to each home in a project that meets the stated conditions. At least 80% of the project’s homes must be sold to qualified residents. Each home must remain owner-occupied for at least one year after its first sale. The one-year owner-occupancy period begins after the first sale; the deed restriction applies upon sale.
A qualified resident must meet the listed citizenship, age, and residence requirements. The definition applies to people buying or renting homes under this chapter. For market-priced homes in an economically integrated project, the developer determines other qualifications.
