Captive insurers could seek exemptions from some examinations
If approved, qualifying captive insurance companies other than risk retention captives could ask the Insurance Commissioner for examination exemptions lasting up to five years.
1
What it does
Non-risk-retention captive insurers could ask the Insurance Commissioner to waive examinations after meeting reporting, compliance, examination, and other good-cause requirements.
Argument forA certificate could let compliant captive insurers avoid some further examinations, reducing repeated regulatory work while preserving the Commissioner's approval power.
Argument againstCompanies may face uncertainty because the Commissioner decides whether their reasons are sufficient and can require another examination after an exemption ends.
More detail
A captive insurance company could apply to the Insurance Commissioner for a certificate exempting it from examination. The process would exclude risk retention captive insurance companies and apply to other captive insurance companies covered by the law. The company must have completed at least one examination to the Commissioner's satisfaction. It must have filed required reports on time and continue filing them. An officer and the captive manager must attest to compliance with required provisions when applying and each year during the exemption. The company must show another good reason supporting the exemption request. The Commissioner could issue an exemption for up to five years, unless it is revoked earlier for good cause. A company could seek one successive renewal no earlier than six months before the current certificate expires.
