Proposal would shift petroleum cleanup costs to state fund
The proposal would have the state fund pay certain petroleum cleanup costs for two programs, subject to site access and owner conduct exceptions.
1
What it does
The proposal would have the state fund cover costs for both petroleum cleanup programs and bar deductibles, copayments, and monetary caps for fiscal year 2025–2026, with exceptions for denied site access and serious owner misconduct.
Argument forIf the rules take effect for the covered year, eligible sites could avoid deductibles and copayments and have covered costs paid by the state fund.
Argument againstThe state fund could cover more cleanup costs, leaving less money for other work it supports.
More detail
The proposal would bar deductibles and copayments, stop enforcement of monetary caps, and have the Inland Protection Trust Fund pay covered activity costs. The rules cover activities under the Petroleum Cleanup Participation Program and the Florida Petroleum Liability and Restoration Insurance Program. The rules would not apply if the department had been denied site access. The fund would not repay costs spent before the grace period began. If the department discovered gross negligence, intentional damage, or records falsified to hide a serious discharge, the site would be ineligible for the incentive program and its owner would owe all discharge costs at that site. The rules specify fiscal year 2025–2026 and expire July 1, 2026. The bill says it would take effect on July 1, 2026.
