Appointing leaders may remove and replace many state board members
Beginning October 1, 2026, several Alabama leaders could remove and replace members of many state boards they are authorized to appoint, with exceptions.
1
What it does
After October 1, 2026, several state appointing leaders may remove and replace members of many state boards, subject to qualifications and listed exceptions.
Argument forThis authority could let appointing leaders respond more quickly when a board member no longer fits the leader's priorities or needs.
Argument againstAllowing removal at any time without following a specific removal process may reduce board members' independence and continuity.
More detail
The Governor, Lieutenant Governor, legislative leaders, and certain minority leaders may remove and replace board members whom they appointed. This covers members of state boards, authorities, and commissions whose members are appointed under state law. A replacement must follow existing law and meet the qualifications for that board. The measure does not cover the Alabama State Port Authority, the State Ethics Commission, or governing boards of public two-year and four-year colleges. The Governor may not use this authority to remove someone the Governor appointed to fill a vacancy in an elected office. The provision would take effect on October 1, 2026, and allows removal at any time after it takes effect.
