The Board of Veterans’ Appeals would report why cases ran late or were sent back and post weekly dates for cases assigned to members.
The Board chairman would identify why new-system appeals missed timely decisions and why appeals were sent back, with counts and percentages for each reason.
Each week, the Board would post docket dates for cases assigned to a member for a decision. Listing would not promise a decision, and priority or court-returned cases would be excluded.
The Board chairman would identify factors behind late decisions and cases sent back for more work. Late-case reporting would cover new-system appeals. Reporting on cases sent back would cover both new-system and legacy appeals. For each factor, the chairman would give the number and percentage of cases affected. The reporting would cover each year, including new-system cases still unresolved at the end of that year and cases sent back during that year.
The Board would publish weekly notices showing the docket dates of cases assigned to a Board member for a decision. The notices would cover each Board docket but not cases moved ahead in line or sent back by the veterans’ claims court. Each notice must say that assignment does not require the Board to issue a decision that week. The Board would publish the notices every week.
