Once certain findings are made, the Interior Secretary would have to use money already set aside in the 2021 infrastructure law to rehabilitate, rebuild, or replace more dams built under the Carey Act.
After finding that other covered dams are funded and money remains, the Secretary would pay to repair, rebuild, or replace Carey Act dams from existing infrastructure law funds.
The Secretary shall use funds under section 40901(2)(B) of the Infrastructure Investment and Jobs Act to fund rehabilitation, reconstruction, or replacement of dams developed and still operating under the Carey Act. It covers dams developed under section 4 of the Act of August 18, 1894, the Carey Act, and still operating as dams under it. The Secretary must first decide that dams already covered by the existing paragraph have received the funding they need. The Secretary must also decide that the section 40901(2)(B) money remains available.
