Starting July 1, 2026, listed changes to a mortgage or secured debt keep the mortgage’s priority, even if the change is not recorded.
For listed changes to a mortgage or secured debt, the mortgage keeps its existing place ahead of later claims. This applies even if the change is not recorded.
For listed changes to a mortgage or secured debt, the mortgage continues to secure the changed debt and keeps its priority. The listed changes include changes to payment dates, interest, unpaid amounts, escrow or reserve accounts, insurance, and financial promises made by the borrower. This applies to listed changes such as extending the due date, lowering the interest rate, changing certain rate terms, adjusting escrow or insurance requirements, and reducing or forgiving amounts owed. The mortgage keeps its priority whether or not the change is recorded. These rules do not apply to changes that release or add property, change who owes the debt, or transfer the mortgage or debt. The law does not invalidate those other changes or take away their priority. This applies to mortgage changes made on or after July 1, 2026, regardless of when the mortgage or debt began.
