Since June 12, 2026, West Virginia law has allowed contractor license holders to apply to transfer a license to certain family members, subject to board review and exam rules.
A contractor may apply to transfer a license to a spouse, child, sibling, or parent. The board may allow a one-year period without an exam if the family member meets a business or staffing condition.
A family member must pass any exam the board requires within a year to keep a transferred license longer. They generally cannot transfer it again before passing, with an exception for death or permanent incapacity.
When a family member holds a transferred license for a business without taking an exam, they must remain a principal owner, partner, or corporate officer.
A contractor license holder may apply to transfer the license to an immediate family member. Immediate family means the license holder’s spouse, child, sibling, or parent. The board may transfer the license for one year without an exam if the family member satisfies the board that they helped manage or run the business, or employ or retain someone who meets the board’s licensing qualifications. The one-year period without an exam begins on the transfer date.
A family member who receives a transferred license must pass any exam the board requires to keep it beyond one year. These rules apply to an immediate family member who receives a contractor license, including a family member applying after the license holder dies or becomes permanently incapacitated. The first recipient may not transfer the license again before passing the required exam, unless the recipient dies or becomes permanently incapacitated. After the license holder’s death or permanent incapacity, an immediate family member may apply for a transfer under the same restrictions. A family member applying after the license holder’s death or permanent incapacity must apply within one year of that event.
A family member holding a transferred license for a business must remain its principal owner, partner, or corporate officer. The rule covers a family member holding the transferred license on behalf of a business entity. This applies when the board transfers the license without requiring an exam under the one-year provision. The business may use the license for one year after transfer before the family member passes any exam the board requires.
