Licensed alcohol sellers may accept a West Virginia Mobile ID to check a buyer's age, but only through a state-approved app and required identity checks.
The law authorizes listed rules for state agencies. The rules cover topics including alcohol sales, banking, insurance, gambling, and taxes. The act took effect upon passage on March 14, 2026.
Licensed alcohol sellers must check buyers' age and identity using acceptable photo identification. This applies to sales of alcoholic beverages and nonintoxicating beer. Accepted photo ID includes certain West Virginia IDs, out-of-state driver's licenses, and other valid forms of photo identification. For a West Virginia Mobile ID, the seller must use a state-approved reader app, and the customer must share their name, photo, and birth date. The app must confirm the ID is valid and whether the customer is at least 21; the seller must match the photo to the customer. The seller cannot make the sale if the customer does not share the data or a check fails. The act took effect upon passage on March 14, 2026.
