Since June 10, 2026, a patient approved for a covered treatment can choose a medically suitable alternative for the same condition without another approval.
A patient with an approved treatment may use a suitable alternative covered by the same plan without another approval, if it costs the agency no more than the original treatment.
A patient may receive a suitable alternative covered treatment without another prior approval. This applies to a patient who already has prior approval for a treatment covered by a Public Employees Insurance Agency health plan. The patient cannot receive the original and alternative treatments at the same time. The alternative must be medically appropriate for the same diagnosed condition, and its allowed cost to the agency cannot exceed the original treatment's allowed cost. A licensed provider must document the alternative's purpose and medical fit. The agency may ask for reasonable cost records; the alternative must already be covered by the plan and cannot start treatment for a new or unrelated diagnosis. The agency may still audit and deny claims involving fraud, waste, abuse, or material misrepresentation. The section took effect June 10, 2026, 90 days after passage.
