In counties that enact the authorized court cost, fraud and economic crimes fees stop being enforced, and existing prosecution funds return after collections reach a set balance.
Once a county enacts the authorized court cost, fraud and economic crimes fees and assessments under this law must not be enforced there.
District attorney general offices must hold existing funds they control until collections from the authorized court cost reach the required balance. Then the prosecution fund account balance goes back to the county where it was originally collected.
The law provides that fraud and economic crimes fees and assessments under this part must not be enforced in a county once it enacts the authorized court cost. This applies within that county to the fraud and economic crimes fees and assessments established in this part. The county must enact the cost authorized by § 40-3-106.
A district attorney general must hold existing funds collected under this part that are in the office’s possession, custody, or control. Once the required collection balance is reached, the § 40-3-207 account balance must be returned to the county where it was originally assessed and collected. This covers existing funds collected under this part that a district attorney general holds, and the balance in the § 40-3-207 account. The comparison is between funds collected under § 40-3-106 and funds deposited in the § 40-3-207 account. The account balance must be returned when funds collected under § 40-3-106 equal or exceed the balance deposited in the § 40-3-207 account.
