Local governments would limit fees for shopping carts on public property
Starting July 1, 2026, local governments would generally be unable to charge shopping-cart owners for carts found on public property unless the business removed them.
1
What it does
Shopping-cart owners generally could not be charged a local fee, fine, or cost when their carts are found on public property. A charge could still apply if the owner or an employee removed the cart from a store or its parking area.
Argument forBusinesses may avoid local charges when a shopping cart reaches public property without being removed by the business or its employee.
Argument againstLocal governments may have fewer ways to recover costs or discourage shopping carts from being left on public property.
More detail
Local governments covered by the two sections would be barred from charging a shopping-cart owner a fee, fine, or cost in most cases. The rule covers a shopping cart found on public property and the cart's owner. A charge would be allowed if the owner or an employee acting for the owner removed the cart from a retail store's premises or parking area. The rule would apply to acts or omissions on or after July 1, 2026.
