South Carolina public entities would be barred from making or changing litigation agreements with firms financially connected to a state lawmaker or immediate family member. The firms could not receive payments under those agreements, except for certain previously approved cost reimbursements.
Public entities would be barred from making, approving, renewing, extending, or materially changing litigation agreements with covered law firms. Covered firms include legal services businesses in which a lawmaker or immediate family member has an ownership, work, payment, or other financial connection. Public entities include state and local government bodies, school districts, and special districts. A covered firm could not receive direct or indirect payment under a prohibited agreement. The exception covers only reasonable cost reimbursements approved before the lawmaker's election and the lawmaker's employment by the firm. The restriction would apply while the lawmaker holds office and for one year after leaving office. The act would take effect upon the Governor's approval.
