Large computing centers meeting the size and connection rules would not count as public utilities when grid electricity sales are secondary to their computing business.
A large computing center would not count as a public utility if selling electricity to the grid is secondary to its computing business.
The proposal would exclude some commercial data centers from the definition of a public utility. A commercial data center must primarily process, store, retrieve, or transmit data, have peak demand of at least 25 megawatts, and connect to one or more Pennsylvania public utilities. The center’s sale of electricity to the grid must be secondary to its computing business. The proposal would take effect 60 days after enactment.
