If enacted, Ohio would direct the division to issue paired dispensary and growing licenses to certain long-standing medical marijuana processors.
The division would issue one dispensary license and one growing license to a qualifying processor. The processor must have kept its license and control of its operations since December 7, 2023, and cannot share ownership or control with a licensed cultivator.
A paired cultivator could grow and sell medical and adult-use marijuana to other license holders and obtain plant material. Its growing area could not exceed 5,000 square feet; expansions would need division approval and stay within that limit.
Licensed laboratories would obtain medical and adult-use marijuana from licensed cultivators, processors, dispensaries, and paired cultivators.
The division would issue the applicant one dispensary license and one paired cultivator license. The applicant must hold a processor license issued on or before December 7, 2023, must not have transferred that license or control of processing operations after that date and before the new licenses are issued, and must not share ownership or control with a licensed cultivator. The applicant must also meet a requirement in section 3796.05(B)(1), which is not included here. The division would issue the licenses within 90 days after this section takes effect.
A paired cultivator could grow medical and adult-use marijuana, sell it to other license holders, and acquire plant material. These permissions apply to holders of a current, valid paired cultivator license. The license holder could not grow marijuana for personal, family, or household use under this license. The growing area could not exceed 5,000 square feet. Expansions would need division approval and could not exceed that limit.
A licensed laboratory would obtain marijuana from licensed cultivators, processors, dispensaries, and paired cultivators. The requirement covers licensed laboratories, including those licensed before March 20, 2026.
