Public construction contracts using standard forms would have to identify changed terms, or those changes would not take effect for covered contracts.
Public construction contracts and subcontracts using industry-standard forms would have to show added or altered terms clearly. Unmarked changes would not take effect.
Public authorities and certain construction firms would have to clearly mark changes to industry-standard contract or subcontract forms. The rule covers public construction authorities, construction managers at risk, design-build firms, general contractors, and their public construction contracts or subcontracts when they use an industry-standard published form. Changes would have to be shown by striking through and underlining the original words, cross-referencing added conditions, or linking added conditions to the standard-form sections they change. If a required change is not marked, the change would be void and the original standard-form language would control. The construction commission's rules would include the same marking requirement for prescribed contract and subcontract forms. These provisions would apply to contracts entered into on or after the effective date of this section and would not apply to contracts already in effect on that date.
